Official Rules

1. NO PURCHASE NECESSARY. PURCHASE WILL NOT ENHANCE CHANCES OF WINNING. Open and offered only to legal residents of the 50 United States and District of Columbia (excluding Puerto Rico) who are 18 years or older (except residents of Alabama and Nebraska, who must be 19 or older) at the time of entry. Employees and directors of Best Buy Stores, L.P. (“Sponsor”), GMR Marketing LLC (“GMR”), The Ellen DeGeneres Show, WAD Productions, Inc., Rihanna, Aerosmith and their respective parent entities, subsidiaries and affiliated companies, advertising, promotion, or production agencies, Web masters and Web suppliers and their respective IRS dependents (collectively “Released Parties”), immediate family members [children, spouse, parents, siblings] and individuals residing in their same household) are not eligible to participate or win. Void in Puerto Rico and where prohibited. By participating, entrants agree to these Official Rules and the decisions of the Sponsor, which are final and binding in all matters relating to this Sweepstakes.

2. HOW TO ENTER: The Sweepstakes will start at 8:00:00 p.m. Eastern Time (“ET”) on Thursday, November 22, 2012, and end at 5:59:59 a.m. ET on Friday, November 23, 2012 (“Promotion Period”). Sponsor will distribute the promotional hashtag, #inlineatbestbuy, via Best Buy’s Twitter account and in-store advertising during the Promotion Period (exact time to be determined by Sponsor). To Enter: (1) Create or use your existing account on www.twitter.com (“Twitter”); (2) follow the Best Buy Twitter handle at www.twitter.com/BestBuy; and (3) either (a) tweet with #inlineatbestbuy hashtag to @bestbuy, or (b) tweet your answer to the question “Tell us which Best Buy Black Friday deal you are standing in line for tonight” with #inlineatbestbuy hashtag to @bestbuy. Tweeting the answer to the question is optional. Tweets may not exceed 140 characters. Tweet must be made by the authorized Twitter account holder at the time of entry. “Authorized account holder” is deemed as the natural person who is assigned to a Twitter address. Potential winners will be randomly selected each hour during the Promotion Period in an Hourly Prize drawing. NON-WINNING ENTRIES WILL ROLLOVER TO SUBSEQUENT HOURLY PRIZE DRAWINGS. LIMIT ONE (1) ENTRY VIA TWEET PER PERSON/TWITTER ACCOUNT HOLDER. If your Twitter account is private, your Tweet will NOT be eligible. Please Note: You must have a valid Twitter account and agree to the Twitter Terms of Use and the Twitter Privacy Policy in order to be eligible to enter. Registration on Twitter must be completed before an entry may be submitted. Twitter membership is free. The Twitter platform will be the official time clock for the Sweepstakes. Any attempt at email or other Internet entry is void. Any attempt by any person to submit more than the stated number of entries by using multiple/different accounts or any other methods will void that person’s entry and that person will be disqualified. Tweets that contain information that is deemed to be lewd or profane; contain material that violates or infringes on another’s rights, including privacy, publicity or intellectual property; material that is hateful or defamatory; material that promotes bigotry, racism, or harm against a group or individual or promotes discrimination; material that is unlawful or in violation of or contrary to the laws or regulations in any state; or are otherwise deemed by Sponsor, in its sole discretion, to be inappropriate, will be disqualified as determined solely by Sponsor. Sponsor makes the final determination as to which Tweets are eligible to take part in the Sweepstakes. Posting of a Tweet on www.twitter.com/BestBuy is not verification that the Tweet is a qualifying entry. By entering, entrants agree that all Tweets become the property of Sponsor and will not be acknowledged or returned. By entering a Tweet, each entrant warrants that it is original and created by the entrant, non-confidential and legally created, and grants Sponsor the perpetual, unlimited and irrevocable right to post, publish, adapt, edit, make derivative works and/or otherwise use the Tweet in any manner, including copyright, and in any media now known or hereafter developed.


3. WINNER SELECTION/NOTIFICATION: Potential winners will be selected at random via ten (10) Hourly Prize drawings during the Promotion Period. NON-WINNING ENTRIES WILL ROLLOVER TO SUBSEQUENT HOURLY PRIZE DRAWINGS. The drawings will be conducted by GMR, an independent judging agency, whose decisions are final and binding in all matters relating to this Sweepstakes. During the Promotion Period, potential prize winners will be notified by GMR via direct message to his/her Twitter account with a link to the Best Buy redemption website and instructions explaining how to redeem his/her prize.  Potential winners need not be present to win.  Potential winners must respond and redeem within 24 hours of attempted notification to claim his/her prize.  If a Potential winner does not respond and redeem within 24 hours of attempted notification to claim his/her prize, the prize will be forfeited and a potential alternate winner will be selected from the non-winning entries submitted within the Promotion Period.  Two (2) additional attempts will be made to award prizes to potential alternate winners.  If a prize remains unclaimed after these attempts, the unclaimed prize will NOT be awarded. Potential alternate winners will be selected and notified in the same manner and under the same conditions outlined above for the Hourly Prize drawings.  If a person does not claim his/her prize, he/she will not be eligible for subsequent Hourly Prize drawings during the Promotion Period.  Limit one (1) prize per person/Twitter account holder during the Promotion Period.

Total Approximate Retail Value of all prizes to be awarded during the Promotion Period is $200,750. Winner may not substitute, assign or transfer prize, or redeem prize for cash, but Sponsor reserves the right to substitute prize with a prize of equal or greater value should the advertised prize become unavailable for any reason. Taxes on prizes are solely the winner’s responsibility. Prizes will not be fulfilled outside the 50 U.S./D.C. Odds of winning depend on the number of eligible Tweets received for that drawing. Gift cards are subject to terms contained on gift card.

Actual value of trip prizes may vary based upon point of departure and airfare fluctuations, and any difference between actual costs and ARV will not be awarded. All expenses not stated in these Official Rules are solely the responsibility of the winner, including, without limitation, tips, gratuities, service charges or taxes, meals, ground transportation not specified, hotel room service, beverages, merchandise, souvenirs, local and long-distance telephone calls. Travel and accommodations are subject to change and availability, and restrictions may apply. Winner and winner’s travel companion must each be 18 years of age or older (except residents of Alabama and Nebraska who must be 19 years of age or older); however, if a the travel companion is a minor in his/her jurisdiction of primary residence, all affidavits, releases and undertakings set forth in these Official Rules must be executed and undertaken by the parent/legal guardian of the minor, both on behalf of themselves and the minor; and the minor must be accompanied by his/her parent or legal guardian at all times during the trip. Winner and winner’s travel companion must complete, sign and return all affidavits, releases and other documents required by Sponsor prior to ticketing of prize; must have all required documentation prior to departure and are responsible for obtaining such travel documents; must travel on the same itinerary; must travel on the dates specified by Sponsor, which are subject to change; must present valid government issued photo ID for any events; and must comply with all airport and venue security requirements; or prize will be forfeited in its entirety and may be awarded to an alternate winner, provided sufficient time remains to verify alternate winner and ticket prize, otherwise prize will not be awarded. Sponsor reserves the right in its sole discretion to suspend or cancel the participation of any winner or travel companion due to noncompliance with any security procedure or inappropriate behavior or misconduct. If trip destination is located less than 200 miles from winner’s residence, Sponsor, in its sole discretion, reserves the right to provide winner with $500 in spending cash for driving expenses in lieu of airfare/car service. Travel accommodations are at the discretion of Sponsor. No responsibility is assumed for any cancellation or rescheduling of the any event or activity in whole or in part. If any event or activity is delayed, postponed or cancelled for any reason, the travel portions of the prize shall constitute full satisfaction of Sponsor’s prize obligation to winner and no substitute or additional compensation will be awarded. If winner cannot take the trip as stated, prize will be forfeited in its entirety and may be awarded to an alternate winner, time permitting. Sponsor will not replace any lost, mutilated, or stolen tickets, travel vouchers or certificates. All applicable taxes, insurance, travel-related expenses not set forth herein and other expenses which may be required for the enjoyment and use of the prize are solely the winner’s responsibility.

5. CONDITIONS OF PARTICIPATION: Participants agree (a) that Sponsor, GMR, and their respective parent entities, subsidiaries and affiliated companies, advertising and promotion agencies, any companies who are promotional participants or prize providers, and Web masters and Web suppliers, and all of their respective officers, directors, employees, representatives and agents and Released Parties, will have no liability whatsoever for, and shall be held harmless by participants against any liability for any injuries, losses or damages of any kind to persons, including death, or property resulting in whole or in part, directly or indirectly, from acceptance, possession, misuse or use of any prize or participation in this Sweepstakes or any Sweepstakes related activity; or for any printing, production, typographical, human or other error in the printing, offering or announcement of any prize; and (b) except where legally prohibited, winners grant (and agree to confirm that grant in writing) permission for Sponsor and those acting under its authority to use his/her name, photograph, voice and/or likeness, for advertising, trade and/or publicity purposes without additional compensation in all media now known or hereafter discovered, worldwide and on the Internet and/or World Wide Web, without notice, review or approval. Trip prize winners and prize winners of prizes valued over $600 will be required to complete, sign and return an Affidavit of Eligibility, a Liability Release, and where lawful, a Publicity Release within three (3) calendar days of attempted notification. For prizes $600 or more in value, winner’s social security number or taxpayer ID may be required in order to issue a Form 1099-MISC showing prize ARV as income to winner. If documents are not returned on a timely basis, or if prize or prize notification is returned as non-deliverable, or if a potential winner is found to be ineligible or not in compliance with these Official Rules, such prize will be forfeited and awarded to an alternate winner, time permitting. If a winner is a minor in his/her jurisdiction of residence, the prize may be awarded in the name of, or to, the winner’s parent/legal guardian, who must execute all documents and agree to all obligations and undertakings of winner, both on behalf of himself/herself and winner, or prize may be forfeited and awarded to an alternate winner, time permitting. In such a case, the winner would become the travel companion to his/her parent/legal guardian. The trip winner’s guest must also complete, sign, and return an acceptable affidavit of eligibility, mutually acceptable liability release, and publicity release prior to the trip. If the travel companion is a minor in his/her jurisdiction of primary residence, all affidavits, releases and undertakings set forth in these Official Rules must be executed and undertaken by the parent/legal guardian of the minor, both on behalf of themselves and the minor; and the minor must be accompanied by his/her parent or legal guardian at all times during the trip. The prizes under $600 in value will be sent via email or express mail within two (2) weeks following the conclusion of the Sweepstakes. If any notification is returned as undeliverable, the prize will be forfeited in its entirety and an alternate winner will be selected, time permitting. By participating in this Sweepstakes, you acknowledge and agree that Sponsor may collect the personal information submitted by you, and use the information for purposes of Sweepstakes administration pursuant to Sponsor’s privacy policy available on-line at www.bestbuy.com/privacy or by calling 1-888-BEST BUY.

6. LIMITATIONS ON LIABILITY: Released Parties are not responsible for illegible, lost, late, damaged, destroyed, inaccurate, delayed, incomplete, postage due, unintelligible, non-delivered, misdirected, stolen entries; or for incomplete, inaccurate, lost, interrupted or unavailable network, satellite, telephone networks or lines, cellular towers or equipment (including handsets), computer on-line systems, computer equipment, software, viruses or bugs, servers or providers, or other connections, availability or accessibility; or for unauthorized access to, or alteration of entries; or miscommunications, failed computer, telephone, cellular, satellite, or cable transmissions, lines or other technical failure; or for jumbled, scrambled, delayed, or misdirected transmissions, computer hardware or software malfunctions, failures or difficulties; or for any other errors of any kind, whether human, technical, mechanical, electronic or network, including, without limitation, any errors which may occur in connection with the administration of the Sweepstakes or in any Sweepstakes-related materials; or for the incorrect or inaccurate capture of entry or other information, or the failure to capture any such information. Persons who tamper with or abuse any aspect of the Sweepstakes or Web site, as solely determined by the Sponsor, will be disqualified (and all associated entries will be void), and Sponsor reserves the right to terminate such entrant’s eligibility to participate in this or any other promotion offered by Sponsor. Entries generated by robotic, programmed, script, macro or other automated means or by any means which subvert the entry process will be disqualified. Released Parties are not responsible for injury or damage to participants’ or to any other person’s computer related to or resulting from participating in this Sweepstakes or downloading materials from the Web site. Should any portion of the Sweepstakes be, in Sponsor’s sole opinion, compromised by virus, worms, bugs, non-authorized human intervention or other causes which, in the sole opinion of the Sponsor, corrupt or impair the administration, security, fairness or proper play, or submission of entries, Sponsor reserves the right at its sole discretion to suspend or terminate the Sweepstakes, and select winners for the corresponding drawing from all non-suspect, eligible entries received for such drawing(s) prior to action taken or as otherwise deemed fair and appropriate by Sponsor. Without limiting the release provided above, and for greater certainty, Released Parties will not be liable for (a) any incomplete or inaccurate information, whether caused by wireless device users or by any equipment or programming associated with or utilized in the Sweepstakes, or by any technical or human error which may occur in the processing of entries; (b) the theft, destruction or unauthorized access to, or alteration of, entries; (c) any problems with or technical malfunctions of telephone networks or lines, computer on-line systems, servers or providers, computer equipment, software, viruses or bugs;  (d) any failure of any message to be received by or from Sponsor for any reason including but not limited to traffic congestion on the Internet or wireless waves or at any Web site or combination thereof; or (e) damage to a participant’s or other person’s system or equipment occasioned by participation in this Sweepstakes. In the event of a dispute as to ownership of a winning entry, the authorized account holder of the Twitter account at the time of entry used to enter will be deemed to be the entrant and must comply with these Official Rules. “Authorized account holder” is deemed as the natural person who is assigned to a Twitter address.

IN NO EVENT WILL THE RELEASED PARTIES BE RESPONSIBLE OR LIABLE FOR ANY DAMAGES OR LOSSES OF ANY KIND, INCLUDING DIRECT, INDIRECT, INCIDENTAL, CONSEQUENTIAL OR PUNITIVE DAMAGES ARISING OUT OF YOUR ACCESS TO AND USE OF THE WEB SITE OR DOWNLOADING FROM AND/OR PRINTING MATERIAL DOWNLOADED FROM WWW.BESTBUY.COM, OR ANY OTHER WEB SITE ASSOCIATED WITH THIS SWEEPSTAKES. WITHOUT LIMITING THE FOREGOING, EVERYTHING ON THE WEB SITE IS PROVIDED “AS IS” WITHOUT WARRANTY OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO, IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE OR NON-INFRINGEMENT. SOME JURISDICTIONS MAY NOT ALLOW LIMITATIONS OR EXCLUSION OF LIABILITY FOR INCIDENTAL OR CONSEQUENTIAL DAMAGES OR EXCLUSION OF IMPLIED WARRANTIES SO SOME OF THE ABOVE LIMITATIONS OR EXCLUSIONS MAY NOT APPLY TO YOU. 7. GOVERNING LAW: Except where prohibited by law, all issues concerning the construction, validity and enforcement of these Official Rules, or the rights and obligations of the entrant and Sponsor, shall be construed and governed by the laws of the state of Minnesota, without regard to conflicts of law. All suits or claims brought in connection with this Sweepstakes must be brought in a state or federal court in Minneapolis, Minnesota.

WINNERS LIST/OFFICIAL RULES REQUEST: For names of winners, or a copy of these Official Rules, send your request with a self-addressed, stamped envelope postmarked by February 22, 2013 to: Best Buy Black Friday Tweet-to-Win Sweepstakes - Winners List/Official Rules Request (you must specify which), 5000 S. Towne Drive, New Berlin, WI 53151. Requests must be received by March 1, 2013. Official Rules will also be posted at www.inlineatbby.com and available onsite at Best Buy Store locations during the Promotion Period.
